COLLABORATIVE LAW


In this process, you each appoint a specially trained collaborative lawyer and you and your respective lawyers all meet together to work things out face to face.

Both of you will have your lawyer by your side and so you will have their support and legal advice throughout the process.

At the start, you sign an agreement that commits you to trying to resolve the issues without going to court and prevents the appointed lawyers from representing you in court if the collaborative process breaks down. That means everyone is absolutely committed to finding the best solutions.

If you don’t feel up to negotiating on your own behalf, are not sure about the financial side of things, or feel vulnerable when in the sole presence of the other party, collaborative family law could be a good option for you.

If you reach agreement during the collaborative process, your lawyer can obtain the divorce decree and prepare the court papers confirming what you have agreed.

This process is particularly helpful for couples with children who want to continue to co-parent their children and who have the desire to come out of the process with, for example, the ability to attend future celebrations for their children without the usual animosity and bad feeling that can unfortunately often follow the traditional divorce method.

The collaborative process can also allow the consideration of far wider issues than would ordinarily be dealt with in the traditional divorce process. Clients will often find it very healing to be able to work face to face with each other’s vulnerability and most clients find that in these circumstances they can be kinder to each other than in a courtroom.

The collaborative process may not be suitable for everyone but for those who feel that they would like more control over their divorce and a chance of parting with less risk that they will become adversaries it is worth exploring further.
